The At-Fault Party Owed You a Duty of Care

In a legal context, a duty of care is an obligation to act in a way that avoids the risk of harm. For example, the owner of a grocery store has a duty of care to maintain safe premises for their customers.

They Breached That Duty

When someone has failed to live up to their duty of care, they have breached it.

For example, suppose that the grocery store owner opens the store when there is a sheet of ice right in front of the door. The owner makes no effort to remove the ice, and they don’t put up any signs to warn customers. This is a breach of their duty of care to guests and customers.

Their Breach of Duty Was the Proximate Cause of Your Injury
